Student Image Use Guidelines
The following guidelines apply to the use of photos, videos, and/or audio recordings (“Image” as used herein) of TVCC students that are maintained and distributed by TVCC. These guidelines do not apply if an Image is not being taken or distributed by TVCC.
TVCC has designated student Images as directory information under the Family Educational Rights and Privacy Act (“FERPA”) if such Images are taken at a public event or in a public space where there is no reasonable expectation of privacy. Thus, a release is not needed from a student for such Images that are directory information.
Further, a release is not needed if a student’s Image is incidentally captured only as part of a background, or in a large group shot, or there is not a specific focus on the student.
A photo release will be supplied to the student by TVCC if required hereunder. A photo release is only typically required if:
- The student is the primary focus of the Image, is recognizable, and the Image was taken in a non-public setting or at a non-public event.
- The student was asked to be photographed or in a video and agreed to same.
- A minor is being photographed or videotaped.
